To my knowledge, the offices of construction agencies/real estate establishments are covered under the ESI Act, 1948, and the rules/regulations framed thereunder as a "shop." However, the employees/labour engaged at building construction sites are not covered since construction employees, in general, are not covered under the said Act. Additionally, construction employees/casual employees engaged for repair, maintenance, and extension of buildings in already covered units/factories are also covered under the said Act as employees under section 2(9) of the Act.
