Is Your Company Obligated to Provide an Experience Letter After Termination for Indiscipline?

Could anyone advise me on the following? We have had a couple of incidents where associates were terminated due to indiscipline. In this case, is the company liable to issue an experience letter? If yes, is there a different format for the experience letter?

Contractual Obligations

The labor relations are governed by the contract, and everything must be done based on the contract. As per the law, the end of employment terms must be very clearly stated. So, you need to check out the contract. Please note that the Arabic version holds precedence over the English version.

Key Rules to Consider

The rules include the following (though you need to check for details, including what to do for indiscipline):

• The employer, on the expiry of the service contract, will have to provide the employee with a service certificate, free of charge, indicating the date of employment, type of work performed, and the amount of wage received. The employer should also return to the employee the documents and certificates submitted to the employer.

• On termination of the service of the employee, the employer is liable to bear the cost of return to the employee's home country, or to any place agreed upon between the parties. The employer shall complete the proceedings of returning the expatriate employee within a period of not more than two weeks from the expiry date of the contract.

• However, if the employee joins another employer before his departure from the State, then it is the duty of the new employer to bear the travel expense of the employee.
