Is It Legal to Be Terminated Without Notice After 10 Years? Seeking Gratuity Advice

kachopa
I have been working in an institute for the past 10 years, and now they have terminated me without any notice. I want to know if it is legal and if I will get my gratuity or not.

Please let the forum know what the reason was for such termination. Were you given any show cause notice or warning letters? Please elaborate to provide a favorable view.

I am working as a junior engineer in an engineering institute, and yes, I have received an appointment letter. The reason for my termination was that I was on leave without any prior permission for two days. However, since it was a semester break and no classes were being conducted, my absence would not affect the department. I had previously been issued a show cause notice for minor mistakes, but now, after 10 years of service, they have terminated me without any notice period. Therefore, I would like to know if I will receive my gratuity or not.

You will receive gratuity as you have completed 10 years, and the termination is due to absconding, not for any major incident, cause, or misconduct. You must request the gratuity within 30 days of your termination using the prescribed format.
