Transfer of worker from one state to another state.
What are the procedures to be followed?
Is there any hike to be given in salary?
Current state minimum wages & cost of living index is lower. How much percentage of increase to be given in the salary while transfer?

If there is a condition in appointment order then you have right to transfer employee any where in India, and after transfer, you have to pay the equal grade pay applicable in transferred state. Transfer should be in a routine manner and it should not be with ill motive.

transfer should be for administrative reasons and genuine not as a measure of punishment or otherwise.

My query is
Company is shifting from one state to other state, ie Puducherry to Tamil Nadu (Near Chennai)
What is the settlement to be given for employees not willing to go Tamilnadu?
What is the percentage of hike to be given for employees transfering to Tamil Nadu? Because in Puducherry ,cost of living is lower than the Tamil Nadu.

An employee may be transferred from one location to another location of the company provided that neither the wages and other conditions of service are adversely affected.If it is in the other state,the employee is entitled for dearness allowance and city compensatory allowance as applicable in addition to transfer benefits as per rules.His basic pay, grade & scale of pay will remain the same in case of a parallel transfer.There cannot be different grade & scale of pay for the same post in the same company.

Transfer Policy is a part of HR Policy itself. There are various modalities & benefits (some times deduction also applicable) would accrue in transfer cases. Normally these benefits go by the status and difficulties associated with the place of postings. Very rarely additional increments are given when HR policy provides for it. Other wise allowances associated in such places are given where additional expenses are to be incurred such as remote areas, hilly/icy terrain etc. However in your case it's from Puduchery to Chennai transfer would involve hike in HRA, CCA commensurate with 'A' class (metro) cities. If you are a small private firm you might rarely follow emoluments broken into Basic, DA, HRA, CCA pattern instead a consolidated salary may be in vogue. In which case a lump sum increase or certain %age, (say @ 10% on basic etc.) for the period of posting in Chennai/TN could be considered. The quantum is left to you and it should be attractive as well, to lure them to accept the transfer readily though transfer cannot be refused by an employee as per service conditions (refer your apptt. order or HR Policy).

Please check whether transfer liability is incorporated in the company rules and regulations or CERTIFIED STANDING ORDERS. If it is incorporated, the transfer is in line. Regarding other things, the pay and perks hitherto, getting, should not be less than what he is drawing at the time of transfer. Further, grant in aid for transportation etc is allowed. In any case, the wage should not be less than the wage applicable to the transferred place or state.

Dear Gopu,
Normally worker category people are not transferred out of state ( even with in state in many cases). Any such transfer is possible only of it is part of the service condition which normally is.
Legal right to transfer ---- Yes it is there. But practically with a human approach ensure his basic comforts before transfer.
