For having a canteen facility, how many employees should be there? Please help me.

According to the Factories Act, the requirement for the number of employees is changing from 250 to 200 within a short period.

At present, there are 250 employees, and the provision for the canteen is mandatory.

Canteen Requirement for Factories

Is your establishment a factory? If so, as per FA-48 (SEC.46), there needs to be a canteen where the number of workmen exceeds 250.

My request to you is that when you raise a query, please be specific about the Act which relates to your query. For instance, your query, "For having a canteen facility, how many employees should be there?" led members to presume it relates to the Factory Act, and they have provided answers accordingly. Some of the following Acts also have provisions for canteens in their ambit as discussed below:

(a) The Contract Labour (Regulation and Abolition) Act, 1970, under its Section 16, requires an employer to provide a canteen where 100 or more contract laborers are employed.

(b) The Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Act, 1979, under its Section 41, provides that in every establishment where the employment of migrant workmen is likely to continue for six months and where migrant workmen numbering one hundred or more are ordinarily employed, an adequate canteen shall be provided by the contractor for the use of such migrant workmen.

(c) The Contract Labour (Regulation and Abolition) Act, 1970, provides that where contract labor numbering one hundred or more is ordinarily employed by a contractor, one or more canteens shall be provided and maintained by the contractor for the use of such contract labor.

(d) The Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, under Section 37, requires an employer to provide and maintain in every place where not less than two hundred and fifty building workers are ordinarily employed, a canteen for the use of the workers.

There may be other legislations containing statutory provisions for the maintenance of a canteen. My motive for providing the illustration above is to emphasize my point that please "BE SPECIFIC ABOUT THE ACT" in the future.

Thanks,

If a factory operates as per FA-48, a canteen will be required if the number of workmen exceeds 250.

Thank you.
