According to Section 14 of the MW Act, when an employee who works for the minimum wage during fixed hours of the day works any additional hours or days in excess of his normal working day, his employer must pay him the overtime rate for every additional hour he works. The overtime rate is the rate enforced under the government's law at the time he works the overtime hours.

It should be paid double the wages for every hour of his extra work and not allowed to work more than 8 hours in a week.

Overtime Payment According to Tamil Nadu Labor Act

As per the Tamil Nadu Labor Act, if a person is doing overtime (OT), we have to pay double the amount of wages. For example, if 100 is the normal wage, we should pay 200 for the overtime hours worked. For PF, the OT amount should not be deducted, but we should contribute to ESI.

In my opinion, if a person is doing OT, it should not be mentioned on the payslip or in the register. Instead, prepare a separate sheet to distribute the overtime wages. By following this approach, you can pay normal wages. Coordinate with your accounts team to execute this effectively.

Remember to be fair to both the employee and the employer.

What you are suggesting is evasion. It is illegal, and you will face significant penalties and definitely be liable for prosecution. Yes, it takes the labor officer or factory inspector just a few hours to gather all details.
