I want to know about the procedures for rejoining employees. Here, one employee resigned for his marriage. After getting married, he wants to rejoin with the same Employee ID. If this is possible, kindly advise me regarding both worker and staff categories.

How many months was he away from work? Have you informed the PF office in your ECR that he has resigned? Have you given him his gratuity if he has completed 5 years of service? These questions are important to guide you further.

If you haven't completed the separation formalities, then you can continue his service since it's the employer's call to retain an employee, which is, again, a good faith gesture from an employee's perspective.

You cannot offer the same Employee ID to an employee (ex-employee) who has resigned previously for any reason. Resignation always signifies a separation from the company/employer, meaning the employee and the employer have no further relation or obligations under any employment conditions.

Once you have accepted the resignation or recorded it in your files, you cannot alter the record. If the employee wishes to rejoin, you must complete the entire joining process again for a fresh employment opportunity.

Procedure for Reappointing an Employee

The procedure for reappointing any employee involves going through the complete formalities for a fresh appointment:

- Create a new employee file following the proper joining procedures.
- Ensure all necessary employee E-registrations are completed.
- Assign a new employee ID, and so forth.

Please adhere to these steps to ensure a smooth rejoining process.

Have you mentioned that the employee resigned in the ECR FORMAT? If so, you will need to assign a new PF code to the same employee. If you have not mentioned it in the ECR FORMAT, you can continue using the same account number. Regarding ESI, the same code number should be followed.

Rejoining procedures will be according to the management policy. The rejoining can either be as a fresh start or with continuity from previous service.

For continuity of service, the ESI and PF numbers will remain the same, and the employee's ID will also be unchanged.

In the case of fresh joining, everything will change as if the employee is newly hired.

The employee who has resigned from the services of the company and been relieved from his duties has ceased his employment, whatever may be the reasons. If he joins again in the same position, the management can exercise its discretion, meaning service conditions, etc. If the employer agrees to accept his willingness, then you have to open a separate file and allot him a new employee code, treating it as a new appointment. In any case, you should not link it with his previous records, codes, account numbers, etc. If an OPF and ESI member, you should allot a new code number.

Re-appointment of an ex-employee will depend on the re-employment policy of your company. It is advisable to rehire the ex-employee as a new/fresh employee by opening a new employee record and assigning a new employee ID number along with a new employee ID card. Similarly, you can arrange to obtain a new Employee State Insurance (ESI) number and a new Provident Fund (PF) account number.
