Actions In Case Of Documents Not Provided By Employees

cmmohla
Dear All,
Kindly advise in case we have some employees who are working with us for 4 & 5 yrs but have not submitted previous employers certificates. Now management wants that we should ask them to provide all documents mentioned in c..v. at the time of joining which the employees are refusing to give by providing lame excuses or probably they were fake.
Kindly advise can we force them now to provide documents? if yes how can we do so and what all action can be taken against them in case they fail to provide the same permissible under the law
Thanks & Regards

Dear Cm mohla,
Now you don't have the authority to force them for management end mistake.
1. why Joining formalities not handled properly.
2. total mistake in administration then how should you force them after 5 years, is it way?
3. After 4 years you will ask them for previous company experience letter, you think from your end.....it shows weakness of your administration.

Hello C.M.Mohla,
Aditya has a valid point.
But you haven't mentioned the reason WHY the Company needs or is insisting the Docs NOW.
What are the numbers involved when you say "....some employees who are working with us for 4 & 5 yrs"?
Going by the same logic you mentioned ".......but what happened is history & we can't change it", just forget about the earlier employees & begin to implement the new Rules from NOW ON----UNLESS there are very strong reasons for asking for the Docs.
Ask the earlier Employees for the Docs, but suggest DON'T insist.
All the Best.

Dear Mr. Mohla,
Joining documents need to be complete at time of joining itself, as you have admitted that, it was not done that time due to any circumstance.
but, logically thinking, asking such documents after 4-5 yrs later, is not relevant, as many of staffs may not preserved such ways.
Therefore, you may take their basic documents like, ID proof, Address proof, etc. for security purpose & start getting the all documents for new comers at least.

Dear all,
We have recently come to know from some internal sources that some employees experiences were fake. However due to refrence policy earlier hr team assumed that their details as on C.V. would be correct .Hence, didnt make an effort to make a check or ask for all the documents. But now the managements has asked us to verify all the credentials.
Thanks & Regards

Hi.....
You are too late in collecting the documents from the employees who are working for 4 years. You must collect all the required documents before joining or you should have put a conditions that your appointment will be subject to production of previous employers relieving certificate or experience certificate. Now you canm issue them a letter as required by the management submit the required documents failing which the matter will be dealt in domestic enquiry. If he failed to submit your documents within reasonable time, you institute a domestic enquiry and act after the receipt of enquiry findings from the enquiry officer.
I hope matter is stands cleared.

As other members has rightly advised it is too late, but that does not mean that you can't ask for it. Kindly send a letter asking them to submit the Certificates in a mild way, failure to do so will lose some percentage/points for increment or the increment will be delayed.
