Can We Issue Form V to Subcontractors in Construction? Seeking Guidance from Experienced Peers

Dear seniors, Ours is a construction company. We receive orders from the government. Some works are handled by us, while some are given to subcontractors.

We obtain Form V from the principal employer to obtain a license where we handle directly. In another scenario, as a principal contractor, do we have the right to issue Form V to the subcontractor? If yes, could you please suggest where I can find this information?

Registration of the Principal Employer

The principal employer has to file an application for registration with the Registering Officer. The application must be made in triplicate and accompanied by a treasury receipt showing the payment of fees. The Registering Officer will then register the company and issue a Certificate of Registration. If the company fails to obtain the Certificate of Registration, the workmen employed by the contractors will be deemed to be employed by the company, which is the principal employer.

Licensing of Contractors

Regarding the licensing of contractors, the principal employer should engage workmen only through licensed contractors. Therefore, the principal employer must ensure that the contractors engaged for various services hold a license issued under the Act.

In summary, the registration responsibility lies with the principal employers, while the licensing responsibility falls on the contractors.
