Leaving The Job After Two Days Of Joining

Hi,
I have joined an IT company two days back but I got good offer from other company which I willing to join, I don't want to serve the notice period since I have not started the work over there. As my offer letter says I will be on probation for six month but they also mention that I have to serve the notice period of 90 days.
Can they take legal action if I don't serve the notice period.

Dear rakesh, kindly go through ur appointment and find out whether there is any notice period when u r in probation.if no then there is no legal case .regards c.m.mohla

If two days later the company had told you to leave since they have got a better/ cheaper candidate than you, how would have you felt and what would have you done ?
Think. The grass on the other side always looks green. But there is a value in being true to your word as well.

Job hoppers, not a healthy practice in long run. somewhere they will be struck and get enlightened. Till such time, they will be on the hopping.

Dear Rakesh,
If i am not wrong kindly proceed with your new best offer,because even HR also not correct few companies they one some figure amount to candidates in salary they are deducting company PF also.Any how you only responsible for your life and your family they won't provide any thing to you.Even company also prefers immediate joins go and join in new offer but be stable in that company.

There is no need of giving notice. But you have to inform that you are leaving the company.

Thanks for the suggestions.
I got mail from the company asking three months salary for in lieu of notice period. Since I was in probation period for first six months it is reasonable to pay the amount because in probation period notice period will be
1 month or less than that.
Please suggest me what to do.

Hi Rakesh and all, I too have the same question to you all. What action will be taken if I dont pay the recovery amount.? In case its too huge and not affordable. And I formally told my HR and the manager about my decision. In fact I was in that company for just one day..

Once you have accepted the offer given by your present employer, you must honor the same. Working with one day or two or one month does not make any difference to get the relieving from the services of your current employer. Nothing is wrong to join in new company, when you got good offer, but you should not ignore the offer given by present employer.
As such, by working till the completion of notice period or making payment in lieu of notice period, you request your present employer to accept your resignation and get a graceful exit in order to avoid complications. The appointment letter is nothing but an agreement in between by an employee and employer. On breach of the terms and conditions by one party, the other party has a remedy to invoke the jurisdiction of competent courts to get relief as per your appointment order
