How to Handle a Notice Period Policy Change When Resigning from Your Job?

I am working as a System Engineer in a company. When I joined the company, my offer letter stated that if we don't serve the notice period of 1 month, then we need to give a month's basic salary. However, now that I have resigned and informed them that I will serve a notice period of 14 days and also give my basic salary, the company is stating that the policies have changed. They now say it is compulsory to serve a notice period of 1 month, and if I do not comply, they will not release me. I have not signed or been made aware of any policy changes. What should I do in this situation? Please help me.

I think they cannot compel you to serve a one-month notice if it is neither mentioned in the revised policy nor communicated to you in writing. They might just be trying to make you stay. Also, try to convince your Head of Department (HOD) if he approves your shortfall of notice. I don't think HR can force it.

One of my senior employees has resigned and also given a cheque in lieu of his notice period. However, we want to write to him, requesting him to serve the notice, and so we want to return the cheque. Because he is on a very important project and we have no second man to take that job immediately. Can I do that? A draft letter would help.

Was the handover of the work done by that senior person? If he has not, then how was he relieved? If he has left without notice but paid the amount for short notice, you can only request him to come for a day or two and hand over the project to some other person. As he is at the senior level, he should understand the importance of handover.

He has not been released. He wants release by next week, which will be one month notice. He has given a cheque for the remaining two months. We are yet to release him. But as per the Appointment letter, he can either serve the notice period or pay an equivalent amount. He has done the latter. But in this case, we would have preferred the former. So we are making this request.
