Does the PF Act Apply to a Contractor with Only 5 Laborers? Seeking Legal Insights

My company is covered under the PF Act. We have hired a contractor with only 5 laborers. My query is whether the PF Act applies to this contractor. Please support your answer - Y/N - with a legal reason. Your early answer will help me to proceed further.
