Absconded Without Notice: Can I Still Claim My Final Pay After 9 Months?

Hi HR Team, I am a Consultant. I worked with an MNC through a 3rd Party Payroll for 3 months, but due to some personal reasons, I absconded without notice. I am now requesting my final pay, which is around 27,000 for 15 days of work. I have sent numerous emails over the past 9 months, but they have not provided the final payment. Finally, I have stopped requesting my final pay.

Two weeks ago, I received Form 16 A for the quarter, which mentions my 15 days' pay and the tax deposited. Please guide me on whether there are any chances of receiving my 15 days' payment. I urgently need your advice.

1. My first question is, when you left the job, were you in the probation period?
2. If you were in the probation period, according to my understanding, there is no need to serve a notice period unless it is mentioned in your appointment letter.
3. During the probation period, it is generally not required to serve a notice period.
4. You are eligible for all the full and final settlements; they should not withhold your final settlements as per the law.

Hi Ravi, Thanks for the reply. I was not in the probation period when I quit the organization. Due to personal reasons, I absconded. Since then, I have been asking for my final settlement, but there has been no response to my emails. Please suggest how I can receive my amount. If the client generated an invoice, why have they stopped my payment?

In that case, they can't hold your F&F settlements if they are not responding to your emails. Here are some steps you can take:

1. Try to consult higher authorities.
2. Contact the labor inspector.

When you are not in the probation period, you should serve the notice period. In this case, they can hold your Full and Final (F&F) settlement if they have mentioned it in the appointment letter. Please let me know if you need further clarification.
