How Can I Recover Unpaid Variable Pay from a Closed LLP Firm? Seeking Advice

Respected Seniors, I worked for an LLP firm from Jan '13 to Jun '14. They deducted a part of my CTC as variable pay for the financial year '13-'14 but did not include it in my FNF. Despite working for the full financial year with no performance issues and no PMS activity conducted with employees, they have closed down on their own. Now that I have resigned, I seek guidance on what steps can be taken to receive my variable pay.

Please check the HR policy to see if they have mentioned anything about variable salary. Many companies have this policy that states, "If an employee is not a part of the organization when they release the variable pay, then the employee will not be eligible for the same."

I have already requested, but they are not answering. They said they are processing my FNF before the disbursement of Variable Pay for the last year. We cannot do anything. Can I take any legal action against them?

Dear Mr. Sharma,

Please check your appointment order/contract. In case they have specified any conditions for the disbursement of Variable Pay and you have fulfilled all your requirements, you may still try legally. I would be able to suggest better if you can share the specific clause on this payment.

First, please check the clause of your appointment letter/service agreement regarding the payment of Variable Pay and then proceed accordingly. If possible, discuss this matter once again with HR. If they are still unwilling to pay, then consider reaching out to the legal department.
