Employer's Liability: What Happens If ESI & PF Deductions Aren't Deposited for 3 Years?

I am now working in a private limited company as an Asst. Accountant for the last 3 years. What is the liability of the employer if ESI & PF deductions were made but not deposited for the past three years?

I am surprised why your company did that. Please give me answers to some questions:

- Does your establishment have PF & ESI codes?
- If yes, have EPFO & ESI bodies issued any notices to the organization?
- What was the reply of your organization to the notice?
- If your organization has not received the notice, please inform the concerned authorities.
- Has no person claimed any PF benefits in the last three years?
- Has no person availed any ESIC benefits in the last three years?

In my opinion, your organization does not have PF & ESI codes.

Dear Susanta, It is better to deposit all statutory liabilities before the due date. • If your establishment is registered under both acts or if any complaint is made, the department will conduct an inspection/enquiry.
