Hi, I work for rent a car company, my working hours are 11 hours * 6 days. The official shift is for 9 hours but we have to wait extra hours.which is unpaid. My Company is registered under the Merchants and Establishments Act. HR says there is no such policy. What should I do?

Dear Sadiq,
Here you need to realize that more information is to be collected on your part -
1) What does your appointment letter say regarding working hours.
2) What does your JD say regarding your profile.
3) Does the HR has any policy manual regarding the working hours and Over time rules.
Please collect the above information and then speak with your reporting officer. If not satisfied by his answers, then discuss the issue with HR.
Please remember that your behavior while discussing the above issue should be polite and in a courteous manner as the subject matter is sensitive. By proper discussion you will be able to change the situation around you.
Regards,
Ashishkumar

Dear all,
The actual working hours for a employee are generally fixed for 8 hours a day 48 hours in a weak excluding breaks for lunch or otherwise under chapter 4 of Factories Act and shops & commercial Act and total spread over of working should not be more than 10.50 hours a day.
If your establishment is violating the provisions, then you can contact your HR or other responsible persons before taking the issue to the designated authorities appointed under the legislature i.e. Labour inspector / shop inspector in your case.

Hello,
You may consult some labor law expert for the same. This is definitely a wrong practice.
But please be aware of the practical situation that u will not be able to work in a private company specially if it a small one after filing a case against the owner.
We all can really understand. also just a suggestion..please look for a change and try to join some organized company with clear rules and regulations!!
Hope it helps!
All the best!

I see that you are located in UK. Doesn't UK have stringent practices for employment? I assume that you are authorised to work in the UK. The exact answer will depend on the law applicable to you. Also, you need to consult someone specialising in labor laws in UK.

Apart from what members above have given inputs, would like to know the designation of yours to ascertain the Job profile. 8 hours working is for Labor class profile/Manufacturing Companies. In service sector areas sometimes staff are required to work for more than 8 hours sometimes it is 9-10 hours.
