Is ESIC Registration Necessary Before Getting PF Registration for Your Company?

I want to know if it is compulsory to have ESIC registration for taking PF registration. I am working in a company where the employer does not have ESIC and EPF registration. We want to register our company for PF, but someone told us that ESIC is first and compulsory for taking PF registration, and without ESIC, you can't register for PF. Please provide me with related information as soon as possible.

1. The coverage under the EPF & MP Act and the ESI Act, 1948 is different. There is no link between these Acts. It would be better to approach the authorities created under these enactments for coverage.

2. The coverage under the ESI Act is limited to the implemented areas as declared under section 1(3) of the said Act, and the minimum number of persons employed is 10 or more. On the other hand, the coverage under the EPF & MP Act is different.

3. It would be even better if you go through the above Acts and the rules/regulations framed thereunder.

PF and ESIC Registration Process

PF is a must and should be done first, followed by ESIC. For ESIC, you can register online. When you register with ESIC, they ask for your PF number. The PF Act states that if you exceed the employee limit from the first day, you have to pay PF, so PF registration has to be done first. For this, you have to go to the PF office, submit the required documents, and get registered.

For ESIC, you can directly register on the website and pay contributions. After getting registered online, your ESIC C-11 form will be generated, and the local ESIC branch manager will send you the signed copy to your registered address. Online, you have to fill in all the required columns. This is my personal experience.

Okay, thank you for the grading information. Could you also please clarify one thing here: if we have registered a company but did not opt for the ESIC facility, and now, after one year, we want to register for ESIC, is it compulsory to pay ESIC contributions for the previous year?

If you have ESIC registration and employees earning less than ₹15,000 per month, you need to contribute to ESIC regardless of whether you have taken the facility or not. Furthermore, if you have not contributed for the previous year, my recommendation is that you ascertain the liability and deposit the same as soon as possible to avoid any legal penalties.
