Is Our FMCG Company Really Covered by the Sales Promotion Act? Seeking Clarity!

Ours is an FMCG distribution company. We have more than 300 sales executives. The labor inspector is saying that sales executives are governed under the Sales Promotion Act. Can you help me determine whether we fall under this act?

Originally, the act was limited to pharmaceutical companies. However, there was a notification 3-4 years ago that extended the applicability to many more industries. You need to check that notification. I think FMCG companies are included.

Just checked. The notification number SO 217(E) dated January 31, 2011, includes 10 new categories that need to be covered. Please check if your company falls under any of these 10 categories. Some of them include soap, cosmetics, household cleaners, disinfectants, biscuits, and soft drinks.
