How Should We Phrase an Offer Letter Clause About Annual Leave During Public Holidays?

Hi Members, we would like to add a clause in the offer letter regarding annual leave. We advise that staff take annual leave when the country they are serving is observing a public holiday.

Proposed Clause for Offer Letter

Can we phrase it as follows: "You shall go on annual leave as and when advised by your superior if the country you are serving is on a public holiday"?

Understanding the Difference Between Public Holidays and Annual Leave

Public holidays are different from annual leave with wages. Why are you combining both? I don't understand. It is not correct.

We are actually a shared service division. Staff are based in Malaysia and provide services to Australian stakeholders. Thus, we would like to advise staff to go on annual leave while Australia is on a public holiday. Otherwise, staff will have very little to do in the office.
