Regarding Resignation - Notice Serve

I am working as ATM engineer and now i got new job so i resign from the organisation and gave 1 month notice instead of 2 month and i am ready to compensate for the remaining 1 month but my manager are not ready to releaving me.he said that has to serve complete two month notice period but it's not possible cause of other employer are not ready to wait for two months for my joining and i cant miss that opportunity. as per the our manager if i not serve the two month notice he not going to do full and final settlement. please help me out

Please go through you offer letter and appointment letter.There might be some conditions regarding full n final payment.
Most of the companies have buy out notice system in which you compensate your short notice days.I would advise with you to sit with your manager and HR to find out some possible way.Also keep yourself in touch with your new HR.
Talk to your seniors and they will understand your concern and as you are ready to pay also I hope they will approve it now or later.also keep all the conversation either on mail or phone call in soft copy if possible so that you can use it in future.you can inform your next employer about the situation in such case some companies do have some formats like self declarattion of last employment which can be used in lieu of relieving letter.See whats your prioritize and act accordingly.

Nothing can be done if your previous employer insists for serving the complete notice period. Discuss with the new employer and if they are willing to take you on board without relieving certificate from the pre.employer, you can take a call in joining in the new location. You have to forget the F/F settlement or request them to make F/F after deducting payment for shortfall in NP.
Again bear in mind that the NP is meant for smooth transition and find a suitable replacement in your position. Hence the clause of NP is formulated and agreed upon which is binding for both the parties.

But i want to ask one more thing that my manager not releaving me due to some issue,can take any legal action.is there any law for employee.

As per said that go through as appointment letter right,but as per appointment letter there is one month notice period and as per the increment letter there is a two month notice period.
But i am not sign on that also not return to HR.

Send a letter giving details of your resignation (enclose copy of your previous letter) and ask them to relieve you immediately by adjusting the notice pay from your eligible amount. Mark a copy to the concerned Labour Department - ACL or DCL, who can help you in this regard. Obtain acknowledgement while submitting any kind of letter to employer, if denied, send them through Regd post with ACK due...
