Hi, I am working in a finance company and I have resigned from my job. As per my offer letter, the notice period clause is mentioned as:
"Your employment can be terminated by you at any time for any reason whatsoever or without assigning any reason, by providing a prior written notice of 1 (one) month to the company."
I have resigned on the 3rd and served the notice till the 19th, and I am ready to buy the remaining 14 days of the notice period. However, my company is not releasing me as they claim the notice period policy has been changed to 3 months by the company. They have informed all the employees by circulating it through email to everybody with a link provided in the email containing all the policies department-wise.
My Queries Are as Follows:
1) I have not signed any document for the change of the notice period apart from my offer letter. So, is it compulsory to serve the 3-month notice period just based on an email sent by HR?
2) I resigned on the 3rd, served the notice till the 19th, and I am willing to buy the remaining 15 days of the notice period. Do I still need to serve the 3-month notice?
3) They are pressuring me to either serve the full 3-month notice or buy it out for the remaining 2 months. What should I do?
4) Also, my reporting manager is stating that the decision on my release is not in his hands, and I need to contact HR for my release. If my reporting authority agrees to waive my notice period, does HR have the right to demand that I serve the notice period?
