What Benefits Should I Expect Before Leaving My Job After 12 Years? Need Help Calculating Gratuity

yramann
Good day, I just want to ask for help with my case. I'm still working in a certain company now, and I was just informed by my manager that she'll end my contract this month. We had this meeting on March 25, and she said it's my one-month notice verbally without any paper from her. In that meeting, she said they'll compensate me for everything. She gave me three months to look for another sponsor, and if not, they'll just give me a final exit. I started working with them in September 2002, and she told me that April 2014 will be the end of my contract. I didn't ask for any reason why; I just said okay.

Benefits Before Leaving the Company

My question is, what are the benefits that I am supposed to have before I leave the company? I have a basic salary of $1400 plus a $500 food allowance. How should I compute it to get the end-of-service gratuity? Please help.

I think you are employed in KSA. Refer to Saudi labor rules for claiming gratuity. I believe it is 15 days' pay for every completed year in KSA if you have served for at least 2 years. Please check.

Reading your case indicates that you are working in Middle Eastern countries, or possibly in KSA. This situation can be categorized as a termination action. According to Saudi Labor Law Part V Chapter Four "End-of-Service Award," you are entitled to a half-month's wage for each of the first five years and a full month's wage for each of the subsequent years. You joined in September 2002 and worked until April 2014, making your total working period around 11 years and 6 months, counted as 11 years only.

Basic Salary: SAR 1400

Year 1-5: 50% eligible
Year 6-11: 100% eligible

Calculation:
Year 1-5: 50% x 1400 x 5 = 3500
Year 6-11: 100% x 1400 x 6 = 8400

Total end-of-service amount: 11,900

Hope this information helps you.

Baim
