Can My Employer Legally Fire Me for Requesting Stress-Related Leave? Seeking Advice

ars80
I work for a leading KPO in Mumbai and have been a consistent top performer in my team. Lately, I have been very stressed due to work pressure, and my doctor has advised me to rest and take a leave for a month. When I discussed this with my organization, they decided to terminate me. Do they have the right to do so? Are there any legal grounds or laws that govern this?

Regards.

First of all, a company can't terminate any employee without a valid reason and proper evidence. If they are trying to terminate you on the grounds of a medical reason, then they are wrong. Your doctor has not yet declared that you can't continue with the job for any medical reason; they have only stated that you need rest, which is due to work stress itself.

You should start communicating with your organization in writing and try to get the reason for termination from them in writing. This may serve as strong evidence for you in the future.
