Struggling with ESIC Eligibility: Can My Parents Get Medical Coverage Despite Pension Limits?

Hello, I draw a salary of Rs 12,000/- per month, and I would like my family to be eligible for ESIC treatment as well. When I requested to add my father and mother for treatment at CMC Limited, Bangalore, HR informed me that my father, who is a retired government employee receiving a pension of Rs 8,000/-, is not covered under ESIC treatment. They also mentioned that my mother is not eligible for treatment. The reason given for discontinuing treatment at ESIC was that my father's monthly income should not exceed Rs 5,000/- to be eligible for treatment. I was told that since his pension exceeds the limit, my father cannot avail of ESIC treatment. Can you please confirm whether it is possible to add my father and mother to avail treatment under ESIC? Thank you.

Please refer to Section 2(11)(v) of the ESI Act, 1948, which defines "family" under the said Act. Please also refer to Rule 61A of ESI (Central) Rules, 1952, which lays down a condition of a monetary ceiling of income of Rs. 5000 per month for dependent parents for eligibility to medical benefits under the said Act.

I think your HR is correct. However, if you are not satisfied, you can visit the appropriate Branch Office of ESIC along with your Identity Card and discuss the matter with the Branch Manager.
