Leave Dilemma: Do Holidays Count as Leave if Taken Before and After?

rachna.singhchaudhary
Dear All, if an employee applies for leave before and after the holiday, will all days be counted as leave? Please advise.

It depends on HR policy, which varies from company to company. This is not statutory. If it has not been mentioned in your policy, then it should not be considered.

It depends on the company policy. In my previous company, they deducted holiday leave (manufacturing company). Now, I am working in a consultancy - MNC where they do not calculate leave before and after the holiday.

Understanding Sandwich Leave

The type of leave you are talking about is known as "Sandwich Leave." This type of leave is applicable in the case you have presented in your query—when an employee takes leaves before and after a holiday, all three days shall be credited to the leave account of the employee.

The sandwich leave also applies when a company works five days a week. Here, when an employee takes leave on Friday as well as on Monday, then all four days from Friday to Monday shall be credited as leaves in the leave account of the employee.

The Sandwich Rule is not a law or act and is not mandatory. Several companies include it in their HR Leave Policy to have control over the frequency of leaves taken by employees and to keep a check on the misuse of the weekends and holidays provided.

I hope this will help!

Casual Leave and Holiday Allowances

Since you are applying for casual leave, a prefix or suffix of closed holidays or weekly off-days may be allowed. However, these allowances depend on the company's leave policy.

The rule of casual leave depends on the company. If a worker avails leave before and after a holiday/weekend off, the following applies:

1. If an employee's leave is sanctioned in advance, then you can consider it as casual leave. If the employee has not had leave sanctioned beforehand, it depends on the company whether to mark the absence or present status. This scenario varies on a case-by-case basis. However, if the employer sanctions casual leave, then you can deduct two casual leave days.

If your company's salary is calculated based on the number of working days, for example, 25, 26, or 27, then continual holidays cannot be considered as casual leave. If your company calculates the salary based on the number of days in a month, for instance, 30 or 31, then it falls under casual leave.

I hope this clarifies your query.

Thank you,

This purely depends on your company policy. In normal cases, if an employee avails leave before and after a holiday/weekly off, then all three days shall be counted as leave.

Dear Rachna,

Greetings for the day. No, leave should be counted only for absenteeism instead of a holiday or week off because leave is provided in lieu of working days instead of holidays.
