Struggling with Unpaid Salaries and Missing TDS: How Can I Recover My Dues?

I joined an organization with a turnover of 1000+ crores, Organization XMC in Hyderabad, and worked as an Assistant General Manager. From 2012, they started defaulting on salary payments, and in January 2014, I resigned as I was unable to continue without salary and had to follow up with vendors for payments.

Financial Overview and Issues

The organization's balance sheet for 2012 shows a turnover of 1245 crores, reserves of 411 crores, a profit of 95 crores, and a 32% dividend. In 2013, no auditor was willing to sign the sheet. Salary payments from June 2013 have not been made, TDS recovered up to May has not been remitted, and there is no Form 16. Additionally, PF deducted from our salaries has not been remitted.

Steps to Recover Unpaid Salary and Dues

1. For the salary not paid: File a complaint with the labor commissioner under the Payment of Wages Act.

2. For the TDS recovered and not deposited up to May: Provide details of yourself and the organization, including the PAN number, to the Income Tax Officer of the relevant income tax circle for the organization.

3. For PF: Submit letters of complaint along with evidence (such as your appointment letters, proof of employment until January 2014, and any relieving letters) to the Regional Provident Commissioner.

4. Send copies of all letters to the organization from which you resigned.

5. Serve a notice for payment of salary through your lawyer.

Hopefully, your former employer will understand and settle all outstanding dues.
