Company Not Providing Separation Documents Even After Sending Legal Notice

mh-7878
Hi,
I left an organisation without serving notice for 2 months. After 1 month, I was told to pay the full and final amount to get the documents. I paid the required amount. Then the company did fraud to me and refused to provide documents. I consulted some lawyers and sent a legal notice to them. However they are not replying on that too. What should I do now. Is it advisable to send a follow up email to them? If yes, what should be written in that.
Please help!

Why did you paid the amount without getting the documents?
Go to your office and ask them face to face politely and request them to get the documents. Nothing will happen if you send legal notice. Why to fight? Go and ask them politely and they will give you everything you need.

Hi Deepa,
Thanks for replying. However, all this communication happened over emails. I trusted their words because the reply was sent through companies hr mailbox. I need the documents, so I confirmed about getting the documents on paying the fnf. They acknowledged the cheque too. However, then they denied to give documents with an excuse that I haven't served the complete notice. What was the point behind adjusting my leave balance and taking the remaining amount if they had to come up with this excuse. Please help in writing a follow up email to them.
Thanks alot!

As the co., failed to give documents even after due paid, it amounts to cheating. Draft a perfect criminal complaint mentionaing all ataching copy of payment, emails etc., & lodge it to the concerned police station. While lodging take a good lawyer with you. Also lodge a labour complaint to Deputy Labour Commissioner.

Also the co., hasno rights to retain the documents in its custody which is also a criminal offence. Draft well your comlaint. The complaint will screw the co.,
all the best
