How to Handle a Company Refusing Separation Documents After Legal Notice?

I left an organization without serving notice for 2 months. After 1 month, I was told to pay the full and final amount to get the documents. I paid the required amount. Then the company defrauded me and refused to provide the documents. I consulted some lawyers and sent a legal notice to them. However, they are not replying to that either. What should I do now? Is it advisable to send a follow-up email to them? If yes, what should be written in that?

Hi Deepa, thanks for replying. However, all this communication happened over emails. I trusted their words because the reply was sent through the company's HR mailbox. I need the documents, so I confirmed about getting the documents on paying the FNF. They acknowledged the cheque too. However, then they denied giving the documents with the excuse that I haven't served the complete notice. What was the point behind adjusting my leave balance and taking the remaining amount if they had to come up with this excuse?

Please help in writing a follow-up email to them.

Addressing Non-Compliance by the Company

As the company failed to provide documents even after payment was made, it amounts to cheating. Draft a comprehensive criminal complaint mentioning all attached copies of payment, emails, etc., and lodge it at the concerned police station. When lodging the complaint, bring a good lawyer with you.

Additionally, file a labor complaint with the Deputy Labor Commissioner.

Company's Obligation to Return Documents

The company has no right to retain the documents in its custody, which is also a criminal offense. Draft your complaint well. The complaint will hold the company accountable. All the best.
