Stuck Without an Experience Letter: How Can I Resolve This with My Former Employer?

Hi, I am Maria, working in a KPO since 7th July 2010. Due to a personal problem, I was under house arrest, so I couldn't go to the office from 12th December 2013 and didn't submit my resignation letter either. Now that I have resolved all my issues and come out of that situation, I need a relieving letter and experience certificate to continue my career. Although I have requested these documents from my company, they have asked me to pay my gross salary for the notice period that I missed. This amounts to two months' salary since I worked until 11th December 2013. During that time, I received a legal notice from my company in mid-December 2013, which I couldn't respond to due to being under house arrest. Can anyone suggest how I can obtain my experience certificate and relieving letter from the company?

In the circumstances of the matter, you could not serve the notice period; hence, you are required to pay for it. Please talk to the HR officials and settle the matter by paying for the notice period and obtaining the experience certificate in return.

Responding to a Legal Notice

Second, you received a notice but were unable to respond to it? You couldn't even send a handwritten reply to the company explaining your situation? Did no one in your household or among your relatives approach the company to clarify the matter? Or at the very least, call and inform them that you are facing difficulties and unable to serve the notice period?

Your account appears dubious to me, which implies that the employer is likely to share the same skepticism—that you commenced employment elsewhere without giving us prior notice, and now, when requested for documentation, you are fabricating a story. Consequently, you should anticipate minimal cooperation from their end.
