Facing a 3-Month Notice Demand Without an Appointment Letter – What Should I Do?

oswal denim employee
I have rejoined a textile company. After joining on 27/11/13, I received an offer letter in which the date of joining was mentioned, along with a clause stating that if I failed to join on or before 2nd December, a handsome amount must be paid to the company.

I resigned on 28th February '14. They are demanding a 3-month notice period payment of Rs. 102,000, or they will file an FIR. However, they are unwilling to provide me with my original appointment letter.

Please guide me.

Questions Regarding Appointment and Resignation

Have you signed an appointment letter where these clauses are clearly stated? What is your correct date of joining? Is this mentioned in the letter? Have you given a formal letter of resignation? Why do you not serve the notice period? What is the amount you have to pay? Is this mentioned in the appointment letter?

Need to understand more details. Please share a portion of the letter you received to understand the exact meaning of the clauses mentioned. Normally, the probation period is considered as 6 months to 1 year - needs to be mentioned explicitly in the Appointment Letter. You may ask for the Full and Final settlement copy which will give you a breakup of the amount you need to pay to the company.

Suggestion

Send a month's basic salary along with your resignation letter by registered post and wait for their response. You will be happily surprised.
