Wasnt Able To Serve The Notice Period... What Can Happen?

Arunrohilla2693
hi,

i worked for a company for two months as a fresher...then my mother got ill(spinal injury) and i had to leave that job without serving the notice period. I did informed my managers and told them about my inability to join the company again. they askd me to write that in formal and to meet them once. but due to the seriousness of my mother's health i wasnt able to complete the formalities.

after two months i got the termination letter from the company.

2 mnths after the termination letter, got a letter frm the same compny stating that they r doing full and final settlement and i have to pay more than 15k to get my relieving letter. Letter also states that if i dont give them the reqt amount then they will initiate the appropriate actions against me.

i don't want any experience letter.

can anybody tell me

1) what r the actions that a compnay can take against me if i do not pay that amount?

2) if i dont gt my relieving letter what kind of problems wud i hve to face in future.

please help.

Please check the appointment Letter with regards to termination clause, secondly what is the amount of 15K your company is asking for, please let the forum know the details so as to advise appropriately,
With regards to your query
1) If the company has given you training for which an amount equal to 15k is spend then you are supposed to pay it (assumed as lack of Appointment Clause) or else the company can initiate legal suit if required so (normally big company does not go for it as it is a meager amount)
2) Termination letter itself is relieving from the job. For your future you have to apply as a fresher only.

The company is asking me to pay in lieu of notice.
Termination clause: an employee has to serve a notice period of one month or pay in lieu of notice period.
I dint serve the notice period coz I had to stay with my mom.
I guess, i have to pay in lieu of notice now. :(

If you have genuine reasons for not reporting to duty, write to them the circumstances and conditions warranted for the discontinuance. If you have joined another company by giving excuses to the previous company, it is not correct.
If the reasons are genuine, ignore their notice if you have not taken any special training.
