First of all you have to judge Gravity of misconduct. Termination is the last and harsh action against employee. If employer wants to terminate employee, HR must follow the principle of natural justice. You have to give him chance to justify his conduct.
Give him show cause notice.
Demand explanation from him.
After explanation you may conduct Domestic enquiry against him.
You have to communicate findings of enquire officer to the employee.
On the basis of findings,take once again written explanation from employee.
On the basis of his explanation, you may take action against him.
Keep in mind, after follow all these legal procedure still employee can challenge your decision in Labour office/court.
