Is There a Chance for Permanent Employment After 240 Days in a Government Contract Job?

joym30
Hello, I am working in West Bengal Sarva Shiksha Abhiyan (SSA), a Government of India's flagship program. Here is a contract of 1 year of service that is extendable up to 3 years.

Question on Job Permanency

My question is, does the job have any possibility of becoming permanent if I worked there for more than 240 days in a year?

In several cases, the court has given judgments that a regular position should be filled through the regular channel of recruitment, i.e., advertisement in a newspaper, calling for applications, screening applications, and conducting interviews (written/oral/physical, etc.). Only then should the regular position be filled. So, I do not think you can claim permanency after completing 240 days.

Sir, my recruitment was done through an official notification, written test, computer test, and interview, like other regular channels of recruitment.

Dear Joym30, if your recruitment for the fixed-term contract is already completed, how can you claim permanency?

Regular positions should be filled through the regular channels of recruitment, such as advertising in newspapers, calling for applications, screening applications, and conducting interviews (written, oral, physical, etc.). Only after this process should the regular positions be filled, and the employees should work for more than 240 days.

Legal Grounds for Regularization

Could you please advise on the legal grounds or any court cases, whether high court or supreme court decisions, that I can refer to for regularization?
