Company Liability for Accidents During Office Hours: What Are My Rights and Options?

Company Liability in Workplace Accidents

I work in an IT company (Timing: 10:30 am to 7:30 pm). The company does not have a canteen. Our lunch timing is 2 pm to 2:45 pm (no snacks timing in the evening).

One day, I went outside the company building at around 5 pm for snacks. I went to a nearby public canteen, where I met with an accident.

Accident Details

I was standing on the footpath when a car came and hit me, resulting in a serious crush injury and requiring bed rest for 3 months (LWP). My office colleagues took me to a nearby private hospital, and an initial amount of 10k was deposited by the boss at that time.

The company is not following any PF or ESI policies. I want to know: What is the company's liability in such a case?

Company Liability in Employee Accidents Outside Work Premises

The company has no liability if the employee is not under any obligation to use the public canteen. The Employee Provident Fund (EPF) has nothing to do with this accident.
