Can I Leave My Job Without Serving Notice and Avoid Background Check Issues?

Hi all, I am a chartered accountant working at Genpact, hired through a campus placement organized by ICAI 2.5 months ago. I have found a better opportunity in the industry and have decided to leave the company. I have already resigned and agreed to buy out the notice period, but the company is insisting that I serve a notice period of 3 months. In the meantime, I need to join the new company. I have not informed my new employer about my previous employment and will be joining as a fresher. Can I leave Genpact without serving the notice period? They have threatened to serve me a legal notice and consider me an absconding employee.

Will my past employment status be discovered in background checks if I present myself as a fresher and do not provide any documents from my previous employment?

Please help me.
