Is the MLWF Charge Justified After Employee Resignation and Settlement? Seeking Advice

Two of our employees on a contract labor basis resigned on November 26, 2013, and the final settlement was completed on December 4, 2013. The contractor company has now charged Rs. 36/- towards MLWF in addition to the full and final settlement. Is this payment required? Kindly advise.

Dear Smriti,

If the dues are for the month of November, then MLWF should not be applicable, irrespective of whether it is paid in December, January, or any other month.
