Is the 26-Day Salary Payment for Workers Really Required by the Factory Act of 1948?

Sharma Murari
I apologize for any confusion, but I work in the personnel department. I would like to inquire whether the payment of 26 days for workers is determined by the Factory Act of 1948 or not?

Thank you.

Yes, worker wages have to be paid on a 26-day basis, irrespective of the type of establishment.

Agreed with Prashant, wages have to be paid on a 26-day basis because the number of working days in a month is 26 rather than 30 or 31 days, as 4 days are designated as rest days.

Thanks & regards,
Sumit

Inquiry About Payment for 26 Days Under the Factory Act of 1948

Sorry, I know little English, but I work in the personnel department. I want to ask, is the payment for 26 days of work decided by the Factory Act of 1948 or not?

Wages should be paid for whole days, i.e., 30, 31, 28, or 29, including Sundays and holidays. If you work for 26 days, you should be paid for 30/31/28/29 days (including Sundays). If there is any loss of pay, the wages should be calculated for 30/31/28/29 days. For example, if the salary is Rs. 5000 in the month of January, Rs. 5000 should be divided by 31 * the number of days absent. This is the correct method because we pay for Sundays and holidays as well; we do not deduct wages for holidays.

I believe you may be confusing wages and salary. Wages are typically for workers and are based on a 26-day period, while salary is for employees and is based on the full days of the month. I concur with Prashant and Sumit.

The government rule states that the company should only provide 26 days of wages and 4 or 5 days of holidays. Therefore, when calculating the daily wage, we need to divide the total monthly wages by 26 days.

Thank you.

To answer your query, I would like to mention that wages are paid to labor on a daily basis (per day wage rate x number of days worked), while salary is paid to employees (workers or staff) on a monthly basis (30 or 31 days). Therefore, please verify whether you have hired workers on a daily wage or monthly salary basis.

Thank you.
Regards.
