Struggling to Get My Relieving and Experience Letters: What Should I Do Next?

Seeking Advice on Obtaining Relieving and Experience Letters

This is my first post in the group as I am in desperate need to get my Relieving Letter and Experience Letter from an organization that I worked with in the past.

My Story

- I worked for 1.8 years in the company and left the company in October 2011.
- I had to leave the company on a day's notice as my new organization wanted me to join ASAP.
- I had to pay a sum stipulated in my contract to the company that I was working for if I did not serve my notice period.
- I paid them the stipulated sum of money before leaving.
- They said they would not issue me a Relieving Letter and Experience Certificate as I was leaving on a day's notice.
- I had spoken to my manager and HR before leaving but to no avail.
- While collecting my FnF settlement cheque, I was not allowed to read the details well; in other words, it was a rush-rush scene.
- I have called them on many occasions, but they say that the operations have not given an OK for a letter to be issued, and hence, they cannot issue the letter.
- Someone has advised me to go and meet them once, whereas someone suggested that I should take a cop along with me, and someone suggested that I send a notice.

I request all of you to help me in this case. What can I do to get the documents as I need them for the future?

The Importance of Responsible Job Transition

Many employees tend to forget about the employer who provided them with a new job. Leaving a job suddenly after working for more than a year is not a characteristic of a responsible person.

Steps to Ensure a Smooth Transition

When starting a new job, it would have been better to inform the new employer and request at least a week's time to peacefully discuss the decision with the current employer and hand over all responsibilities as a responsible employee. In such a situation, the current employer would likely have given clearance for the transition. While appointment or confirmation letters may specify a one-month notice period or the option to surrender notice pay for a shorter notice, cooperation from both the employer and employee is essential, as both parties are significant during the employment period.

Handling Pending Tasks

If there are any pending tasks with the previous employer, offer your availability on weekends or evenings to complete them promptly. Being cooperative in such situations is important.

Requesting Certificates

Regarding the certificate, taking a cop to the employer would not be beneficial. It is advisable to wait and politely request the certificate since there is no urgent need for it. By approaching them respectfully, they are more likely to assist you promptly, considering it is your requirement.

Thank you very much for your prompt reply. I do appreciate and conform to your points. However, I would like to highlight that I had handed over all my work to my colleagues who were to take over my responsibilities after me. I had no pending tasks before leaving as all of my work was up to date.

I do understand that it was not good on my part to act at the spur of the moment and leave the company on such short notice. I did try to negotiate with my new employer for an additional week's time, but they required me to join ASAP.

At this moment, I urgently need those reference letters as I am facing difficulties during my interviews. Kindly suggest whether I should consider taking any legal recourse in this matter.

In regards to your problem, there cannot be a legal angle to assist you. Since you have not quarreled, you should visit the HR of the erstwhile organization and explain your circumstances explicitly. You need not fear violence on their end. Have a face-to-face and one-on-one conversation in an amicable manner. Perhaps this will solve your problem.

Alternatively, please approach your friends to whom you have handed over the charge with a sort of charge handover report in an informal manner. Subsequently, approach your present employer with the letter of appointment, FNF document, and the charge handover informal report, and explain your issue of not receiving the relieving letter for submission. In fact, once you submit the FNF document, no document is required to show either your appointment or relieving from the previous employer.
