How Can I Get My Pending Salary and Final Settlement from a Non-Responsive Ex-Employer?

Hi All, I worked at XYZ Ltd company for 6 months since 13th May '13. Apart from the first 2 months, the salary was significantly delayed every month. I resigned on 26th Sept '13, but because of the retention bonus (15k bi-annually), I extended my employment until 13th Nov '13, which includes the notice period. Before Diwali holidays, the employer paid 40% of October's salary, but hasn't paid the remaining 60% of it. Also, as a final settlement, the salary until 13th Nov and the retention bonus of 15k are also pending. I have received my original documents, which were taken as security for 6 months. I also received the relieving letter and experience letter. All documents were provided on 12th Dec, i.e., a month from the separation day.

As per the contract, this final settlement should have been done within a period of 30 to 45 days from the date of separation, but the period ends on 28th Dec '13. Within this period, I have tried to communicate with the employer via mail, text messages, and telephone, the records of which are with me. He is not responding to any communication whatsoever.

What steps should I take from hereon to get my settlement done?

P.S. - The employer has since closed down that particular department and terminated my two other colleagues without any valid reason. None of the company employees have received November's salary as of 24th Dec 2013.

You can send one more reminder letter to your ex-employer. In this, mention that you have been following up with their office for many days but have not received certain dues. Request them to clear the dues at the earliest. Otherwise, you will have to approach the labor authorities for assistance. Send this reminder letter through Speed-Post only with a CC to the Labor Office for your area.

If they still don't reply, you can directly write to the Labor Office regarding this.
