The employer is not paying the salary on time. He will narrate a whole story when it comes to paying the salary, and he considers whether to pay or not if anybody raises an issue. The employer will immediately fire employees without any notice period and will not pay their salary whenever he feels like firing them. He will terminate them without any prior notice.

Please change the organization at the earliest. This petty fight will not help you in the long run.

The law clearly states the duration for paying salaries to employees, and it depends on the size of the company. In this case, if you are worried that you might be dismissed at any time, it is better to continue until you wish to leave. Otherwise, stand up for your rights, and you can always fight for them. There are plenty of statutory obligations and liabilities that have to be followed by the employer. So decide whether to fight or to stay calm until you find a better place.

Consider Resigning and Seeking New Opportunities

Resign from the company and look for another job. As Prashant has pointed out, it is not worth fighting for this. Do not waste your time, money, and effort over this. It is better to put all these efforts into finding a better job.

Although there are certain laws under the Labour Law to prevent such unfair practices by employers and protect employees from their effects, you will need to fight against it for a long time.

As the other learned members have advised, I'll also suggest that it is better to look for a change, which will be beneficial for your future as well.

Such things happen in a very small organization that has no image or reputation in the market. It is just running. So, first of all, try to change the company as soon as possible. Secondly, try to organize the workforce if they too are feeling deprived of their legitimate rights or dues. If the others are ready to combine themselves with you, you can put forward their demand before the employer. The employer, because I presume there must not be a formal management in functioning due to the size of the company.

There are provisions for interest payment for delayed salary payment in the PW Act. If denied, you can approach the ALC (Central) or RLC (Central) of your area. But initiate any action only after you are more than 100% sure that no other worker will ditch you or you will be the only one to suffer the consequences. If all are united, it is not possible for the employer to dismiss all of you at the same time.

I would not suggest running away from the battlefield. First, let the forum know more about the company and your role in the company. As advised by Mr. A K Jain, if you are supported by your other teammates and not a one-man show, please knock on the appropriate door as advised by Mr. Jain. I believe someone has to initiate a fight against the employer for unfair practices. However, before taking action, make sure that it should not backfire on you at any given point in time. If it does backfire, it should not jeopardize your daily needs. So, act wisely; that's the only advice I can offer.
