Hello senior,
,if any body having salary of rs 15050 or 15100 , then plese let me know whether he is applicable for esic or not??
if yes then then reason ?? & upto what limit

As per my opinion,
Person having Rs.15,000 above fix gross salary is not covered under ESIC at time of joining.

Dear members,
The present wages coverage limit under ESI Act, 1948 is upto and including Rs.15000/- per month. However, the amount of Overtime, if any, should not be added while calculating the wages for excluding any employee from such coverage under said Act. In addition, the employee once covered in the beginning of the contribution period, will continue coverable till close of such contribution period irrespective of any amount of wages.

Even Rs.15001 is not eligible for ESI. The ceiling is Rs.15000, so equal or below to Rs.15000 is the eligibility for ESI

Hi Mamtha!,
The ceiling limit is Rs.15000/PM only. So, equal or below may get eligible. If the salary components have Washing Allowance or Any Reimbursement Allowance it may possible. Excluding those allowance from this 15100 may get eligible. So,give your salary break up. That could help us to solve your query.

Yes 15000 of gross and 1500 of OT will be covered under ESI. OT amount has to be deducted for ESI irrespective of amount.

Dear Mamta,
As per ESI act more than 15000 per month not eligible for ESI deduction. who is getting less than or equal to 15000/- gross salary(Fixed component) they are eligible for ESI deduction. Hence, your query amount not eligible for ESI deduction.

Coverage under the ESI Act, 1948
APPLICABILITY
Under Section 2(12) the Act is applicable to non-seasonal factories employing 10 or more persons.
Under Section 1(5) of the Act, the Scheme has been extended to shops, hotels, restaurants, cinemas including preview theatres, road-motor transport undertakings and newspaper establishments employing 20* or more persons.
Further under section 1(5) of the Act, the Scheme has been extended to Private Medical and Educational institutions employing 20* or more persons in certain States/UTs.
*Note: 14 State Govts. / UTs have reduced the threshold limit for coverage of shops and other establishments from 20 to 10 or more persons. Remaining State Governments/UTs are in the process of reducing the same.
The existing wage limit for coverage under the Act is Rs. 15,000/- per month ( w.e.f. 01/05/2010).
