Yes, sir, the other amendment means 12 months/36 months from the date of renewal/certification, and not the calendar year as it was earlier.

Request guidance, please. Is a dairy (processing milk and making products like skimmed milk powder, curds (dahi), etc.) considered a factory falling within the purview of the Factories Act? Can a part of the dairy, specifically housing the boiler and the backup power generator, fall within the purview of the Factories Act?

Please provide your opinion and any references where I can obtain more information.

A dairy processing milk and making milk products certainly fall within the purview of the Factories Act if, in the precinct of the factory, you have more than the requisite number of workers working. Milk processing and making milk products is a manufacturing process. The entire precinct or premises of the dairy falls under the purview of the Factories Act.

You are advised to read section 2(m) of the Factories Act.

Nice to interact with you after a long time. The Government has not notified the effective date so far. The Government is not ready with rules under this new law, and therefore, there is no notification as of now, as I was informed by someone.
