Recent Amendment In Bombay Shops & Establishment Act

Dear All,
Please find attached a notification of Bombay Shops and Establishment (Amendment) Act 2011 for your information which received an assent of the President on November 11, 2013.

Good to see they have formally extended working hours till 10 pm instead of 8:30 pm
The other amendment, i did not understand. Does it mean that licenses will now be for 12 months instead of calendar year ?

Yes Sir the other amendment means 12 months/36 months from the date of renewal/certification and not the calendar year as it was earlier.

Request guidance please.
Is a dairy (processing milk and making products like skimmed milk powder, curds (dahi) etc. a factory, falling within the purview of the Factories Act ?
Can part of the dairy, housing the boiler and the back-up power generator fall within the purview of the Factories Act ?
Please give your opinion and some references, where I can get more information.

Dear KJainBRD,
A dairy processing milk and making milk product is certainly falling within the purview of the Factories Act if in the precinct of factory you have more than requisite number of workers working. Milk processing and making milk product is a manufacturing process.
Entire precinct or premises of the dairy falls under the purview of the Factory Act.
You are advised to read the section 2(m) of the Factories Act.

Keshav ji, whether the Government notified the effective date, if so a copy of the notification may please be posted.

The Government has not notified the effective date so far.
The Government is not ready with rules under this new law and therefore there is no notification so far, as told to me by someone.
