Leaving My IT Job: Can I Claim Unused Leave and Salary Increment Before I Go?

Lorreta Rebello
I've currently submitted my resignation from an IT company in Mumbai. The problem I'm facing is with the co-founders. They are not providing me with the 3 paid leaves that are still unused. I was expecting an encashment for the same, but I feel that I might not receive it. Additionally, I was due for an increment. After serving a 45-day notice, I'm unsure whether I should receive my incremented salary or not.

Questions Regarding Leave Encashment and Salary Increment

So, basically, I have two questions:
1. Should I receive leave encashment for my 3 unused leaves?
2. Should I receive my incremented salary from the date of increment, even though I have decided to resign?

Awaiting a reply from all experienced professionals. If any legal sections are available for these queries, please share them with me.

In the case of CL/SL, it would not be paid. Only PL would be encashed. Regarding increments, normally, companies do not pay if someone is serving the notice period. Please let me know if you need further assistance.
