Hello,
I have worked in a company for almost 2 years. As per PF Act employees can withdraw their PF amount maximum 3 months after resignation.
More than 3 months have passed and I have not yet got my PF amount. What can I do if the company refuses to part with my PF amount?
Can I approach the local PF office? Please Suggest.

As per PF rules the application shall be processed only after completion of 60 days from the last working day. After that the PF claim will take minimum of 30 days from the day of submission of the application form. Ask the HR whether they have submitted the claim form? Check the date of the acknowledgement & then act accordingly.

First of all, will you please confirm whether you submitted / singed the EPF Withdrawal Forms..??
As per your post, it seems that you are just waiting for getting the withdrawal of the Fund.
As per EPF Act, an EPF Member can claim for EPF Withdrawal only after 60 days of leaving the job. After these 60 days, the claim for withdrawal of fund is sent to the department which is duly signed by the member and attested by employer and then it is submitted to EPFO. After the submission of the withdrawal forms to the EPFO, it takes 15-30 days for settlement of fund.
So, kindly confirm, did your epf w/d form is submitted to the concern epf office??

PF can be withdrawn upto a maximum period of 3 years after resignation and not 3 months .
Beyond 3 years you have to submit an indemnity bond cum affidavit duly notarised along with the PF (Form 19) and pension (Form 10 C) forms .

Before leaving I have already filled in form 10C and 19 and given the necessary documents to be submitted. More than 60 days have already elapsed since my DOR.

Dear Ashle,
It is not a general practice to keep the member's signed Form-10C & 19 in advance at the time of leaving. Although, it doesn't matters, as it will be submitted to the department after 60 days only. As in your case, they might have not submitted the form to the department. So, I would like to suggest you to kindly check the status of your withdrawal request first, if you know your EPF A/c No.

If your form is get submitted to the department, it will show some message. But, if it says "no record found", then it clearly means that your Forms are not submitted.
If so, then it is better to send a reminder letter to your erstwhile organization regarding non-processing your EPF Withdrawal request. Send the reminder letter through speed-post and wait for their response.
Plz. note that, whenever your Form will come in process at EPFO, you will receive a message from EPFO that your so and so request is under process.
