How Should I Calculate PL for Employees with Incomplete Work Months?

I want to know about PL calculation. Till now, I generate 1 PL after 22 working days every month. We do not generate PL at the end of the year, but we do generate them throughout the year. So, I want to know if, in the current month, any employee who has worked only 20 days, should I generate 1 PL after 2 working days in the next month? If I generate only 1 PL in the next month after 22 working days, then his previous 20 days of work become lapses. What should I do?

For example, in November, one employee worked only 20 days, and in December, he worked for 24 days. Should I generate 2 PL in December or only 1 PL?

From which act do you refer to calculate the PL? As per the Act, it should not be less than 18 PL in a year. If an employee avails the PL in between the year, you can give them on a pro-rata basis, which is equivalent to 1.5 PL per month or more.

Nowhere is it written that you have to count 22 working days to get 1 PL as per your query. Please also let us know whether your company comes under the Factory Act or S&E Act. If S&E, then which state, please state so as to guide you further appropriately.

Our company falls under the Factory Act. I know that according to the act, it has to provide 18 PL. However, before my joining, they calculated 1 leave after 22 working days.
