One of the large IT companies in India has started a horrible practice. In the offer letter, it is clearly mentioned that 3 months' salary will be paid if the company decides to terminate employment. However, the company's HR is just calling hundreds of people on Friday afternoon and asking them to write a resignation letter on a piece of paper and leave the company immediately.

Options for Employees Facing Forced Resignation

My question is, when HR calls employees and tries to force them to write a resignation letter on a piece of paper, what are some good options for the employees to compel the employer to pay the 3 months' compensation as mentioned in the offer letter? What proof should the employee collect to fight against the company legally? If someone is forced to give a resignation letter on a piece of paper and asked to leave the company immediately, can the person bring the company to justice?

Discrepancies in Notice Period and Compensation

When an employee wants to resign voluntarily, the company is deducting 3 months' notice period salary, but when the company wants to terminate employees, they are not providing any compensation. Imagine 5000 people getting laid off without any compensation; this way, the company saves 25 crores, which gets added to the company's profit. Is this not cheating and a gross violation of employment laws?

As per the Industrial Disputes Act of 1947, the company is required to pay the notice period if you resign on your own. If they accept the resignation and do not provide compensation, no payment will be made. It is advisable to discuss this collectively and seek legal advice.

Don't give resignation. Let them terminate you. You will be legally eligible to get compensation. If you resign, it will be an indication that you voluntarily left/resigned from service. How can HR force you to write? If they are forcing you, make a complaint to the local police station.
