Facing PF Transfer Issues After Job Switch: Can I Move It Without My Old Employer's Consent?

I worked in a company for 1.5 years. Now I have joined another company, a competitor in the same field. My old company is refusing to pay the PF, and they are humiliating me every time I call them. Can I get this PF transferred to my present PF account without the consent of my previous employer, or should I send a legal notice? Please advise.

Your previous company does not have any right to refuse to pay your PF amount. It is a statutory benefit, and they are obliged to pay it.

Did you have any agreement with your previous employer? Nothing to do with the PF, but since you mentioned that you have joined a competitor, I am asking about it.

Irrespective of any circumstance - even if you were removed from the company for serious misconduct - the company cannot deny signing the PF transfer application.

Has your present employer sent the transfer request, signed by you, to the PF department? Please ensure.

Yes, if there is an unreasonable delay, you can certainly take legal action by sending a notice. However, I suggest you check other methods, like using your friends in your previous organization, to resolve the issue.

For PF transfer, you also require the below-mentioned details:
- Your own previous P.F Account No.
- Last employer's PF Account No.

Without these two pieces of information, your new employer cannot proceed further. To obtain these details, you can check your salary slip or contact the HR person at your previous company.

If you have these two things:

1. Your last company's P.F Account No. (Because every company has its own P.F Account No.)
2. Your P.F Account No. (Mostly it is mentioned in your salary slip)

You can obtain these two things from your old company. The person working on the payroll side should be able to provide this information. You can directly contact them and inquire about the details.

After that, you need to provide these two pieces of information in Form No. 13 and submit it to your new employer. They will handle the further process.

You do not need to seek consent from your previous employer to transfer the PF. Simply fill out Form No. 13 and submit it to the relevant PF office. All the best.

Was the strength of the company above 20?

Did you ever receive a PF account number?

Did you ever receive a pay slip wherein the PF number was mentioned?

Attach these documents, write a complaint, and send it to The Regional Provident Commissioner under Registered Post and UPC, stating the facts. Mark a CC to the Labor Commissioner too. They have to pay it by their nose provided you have a valid proof. If not, report the matter to the Vigilance Branch of PFUI and apply for conciliation with the Asst. Labor Commissioner.

Can you let me know how she can submit the transfer form to the PF office without the present company's stamp and signature on Form No. 13? Additionally, how can the present company complete the stamp and signature process without the PF account numbers from the previous company, both the company's and her own account number?

Without the above details, the PF office will not be able to process anything on the transfer form.
