No Holiday- What Does Law Says??

yrockonu
Dear Sir,
I work in a Financial KPO in Hyderabad. I work in Shifts. My worktime is for 9 hrs including 1 hr for breakfast/lunch.
We have weekly off on Saturday and Sunday. But now my company is forcing me(all employees of dept) to Come n work for Over Time on every Saturday for full day and half day on Sunday. It means they want us to work for 6.5 days out of 7 days every week.
I want to know is this fair and legal?
Dont we have any law/act which could say that an employee should have a minimum no of holiday per week to maintain his health??

For sometime, doing overtime is fine to fulfill the pending tasks, lack of staff like a large group of employees has left without serving the notice period or company have got some project that's delivery is very urgent and they didn't get time to to hire more people etc. and etc and if you are not sure why company is asking for this, you can simply ask them like for how long this will go (overtime).

Sir(s),
I think you are presently working in Nagpur (as per remarks in above column) and perhaps your establishment may be covered as Shops & Commercial Establishment. In shops and commercial establishment laws mostly there are restrictions laid down regarding working hours of the employees.
I will suggest you to please study the provisions of shops and commercial establishments act as applicable in your area and decide accordingly.

Apart from the above explanation, would like to inform that in a week the total working hours should not exceed 48 hours. Please check the same and thereafter speak to the HR in this regard.

All offices, shops and commercial establishment in india have to follow the local regulations. The shop and establishment act in Hyderabad provides for a weekly off, that is compulsory to give. So it is illegal to ask employees to work on a weekly off. In your case, it is Sunday .

The law is very clear on this point the maximum working hours of a week is 48 hours
