Hi, I am Moumita Das. I am going to join a security agency as an HR. Please tell me which laws are applicable in this industry and what registers and returns need to be maintained.

The security agency is also a contractor, so the Contract Labour Act is applicable to them.

If you have more than ten employees, then you must register under the ESIC if the gross salary is lower than Rs. 15,000 per month. Compulsory registration under the Shops & Establishments Act and Professional Tax is also required. Lastly, you must maintain compliance with the Minimum Wages Act and the labor laws of the respective states.

As advised by Santa, all security agencies should enroll with the Shops & Commercial Establishments Act, as well as those that should be enrolled with the Contractors Act as principal employees. Additionally, those agencies should be registered with ESI, PF & PT.

In Shops & Establishments registration, there is no need to submit any return. You just need to follow the registration formalities by filling out the forms and depositing a certain amount in the bank as registration fees.

Professional Tax Registration

For Professional tax registration, you must submit returns online either quarterly or annually, depending on the tax amount.
