Can Inspectors Enter Any Premises for ESI Inspections? Seeking Clarity on Their Rights

R K S MEHRA
Dear Senior, We have our unit in Haryana. An Inspector came to the factory and handed over a notice for inspection of records. Please let me know whether an Inspector has the right to enter any premises and hand over the notice for inspection, or if he will hand over the notice issued from his office. Please advise me.

Regards,

Section 45 of the Employees' State Insurance Act, 1948

Kindly see Section 45 of the Employees' State Insurance Act, 1948, which provides for the appointment of Social Security Officers, their functions, and duties in ESIC. The name of an Insurance Inspector in ESIC has been changed to "Social Security Officer." You have not indicated in your above remarks whether your factory/establishment is covered/coverable under the provisions of the above Act. You can download the above Act from the website of ESIC also.

With kind regards;

Regards
