ESIC Half-Yearly Return Confusion: Should These Employee Details Be Included?

pareshsanghvi
Can anybody please guide on the following:

ESIC Half-Yearly Return Reporting

In the ESIC half-yearly return, we need to report that "During the period ____ nos. of employees employed through the immediate employer have been covered, and a total wage of Rs.____ has been paid to such employees."

My Query

1. If the immediate employer has deducted and remitted the ESIC and submitted the challan to the company, should those employee details be included in the above report?
2. If the immediate employer has not deducted, but the company has deducted and remitted (omitted wages), should those employee details be included in the above report?

Thanks,

Paresh

I would like to know whether ESI Half-Yearly returns need to be submitted or not. Last year, when I submitted the return at the Branch Office, they said that there was no need to submit Half-Yearly returns due to the online facility.

Thank you.

ESIC Half-Yearly Returns Submission

There is no need to submit half-yearly returns under the ESIC scheme. However, an employer who employs 40 or more workers in the half-yearly period needs to upload a Chartered Accountant certificate in the ESIC online portal.

You can generate the half-yearly return Form 5 on the online portal and keep it in your file.
